TIMING: The Nike Back Your Block Grant Program ("Program") begins at 12:01 a.m. (all times are Eastern Time) on 6/15/09 and ends at 11:59 p.m. on 8/24/09.
ELIGIBILITY: Program is open to legal residents of the 50 United States, the District of Columbia and Puerto Rico who are age 13 years or older at the time of entry ("applicant"). Void where prohibited by law. Officers, directors and employees of Nike , Inc. ("Sponsor"), its affiliates, subsidiaries, distributors, retailers, advertising and production agencies, electronic media firm, and members of their immediate families and those living in the same household are not eligible to participate. All federal, state, and local laws and regulations apply.
Visit www.nikebackyourblock.com to complete and submit the online application form ("application") as instructed for your non-profit organization based in the United States or Puerto Rico that Sponsor should review for Nike’s Back Your Block grant program in an effort "to create a better life through sports" ("theme")."
Grant Criteria:Incomplete applications will not be honored. Applying organization must be able to provide a copy of its 501(c) 3 tax-exempt verification. to qualify to receive a grant. Applications become the property of the Sponsor, and will not be returned. Limit of one application per person or email address. Online applicants must be the authorized account holder of the email account from which the application is made.
Community feedback and voting will be a contributing factor in the decision making process. However, the final decisions will be made by the NikeRetail Grant Committee based on the merits of the proposal, the applicants’ impact to the community and the long-term potential of the project. To generate support for your nomination, have friends and family vote for your nomination at www.nikebackyourblock.com. All applications not otherwise disqualified will be posted at the Program website during the Program period for public viewing and voting. Limit of one vote per application per person per day. Voters e-mail addresses will only be used to monitor voting frequency restrictions.
Application must be written in English and must be the sole original work of the applicant. If you submit a photo or artwork containing the likeness of anyone other than yourself, you must have prior permission from that person. Applications may not include: (a) any material for which the applicant does not have rights, including but not limited to images, copy, trademarks, or trade dress, look-alikes of celebrities or other public or private figures living or dead, or profanity, nudity or material deemed offensive to the Sponsor or its agents; (b) false or defamatory statements about any person or any third party; (c) third party trademarks which suggest affiliation with any trademark owner without permission of such owner or that dilute the value of any trademark; (d) act which is dangerous or harmful to person or property or suggests/depicts any person to undertake a dangerous activity; or (e) obscene, indecent, violent, sexually explicit, abusive, discriminatory, racially inflammatory or other morally or legally objectionable depictions of material, in the opinion of the Sponsor or it agents. If an application includes any of the prohibited elements listed above, the application will be disqualified, along with the applicant who submitted it. Sponsor reserves the right to modify or reject any application, in their sole discretion, that does not meet the above criteria. Once submitted, an application cannot be modified.
TWO TYPES OF GRANTS:
Sponsor, in its sole discretion, will determine grant recipients, pending verification of eligibility, on or about 9/30/09. The maximum grant money to be awarded in this Program is up to $650,000, pending the receipt of qualified applications based on the sole discretion of Sponsor. Grant is not transferable.
GRANT TERMS:
Grant recipients must sign a contract requiring, among other items, maintenance of separate records of disbursements and receipts related to this grant, and file a report detailing the use of funds and program results. Grant recipients are also required to cooperate with periodic program evaluations by Sponsor or its agent. Sponsor reserves the right to review the conditions and procedures of the Grant program and to make changes at any time, including termination of the program.
USE OF APPLICATIONS:
Except where prohibited, by submitting an application in this Program and accepting a grant, you hereby grant Sponsor an irrevocable nonexclusive, perpetual, worldwide, royalty-free right and license to use, display, publicly perform, modify, reproduce, publish, distribute, make derivative works of, sublicense and otherwise commercially and non-commercially exploit your application and all copyright, trademark or other intellectual property rights therein, in any manner or medium now existing or hereafter developed, without separate compensation to or permission by you or any other person or entity. You hereby represent and warrant that (a) you have all necessary right, power and authority to grant the license set forth herein to your application and (b) your application does not violate, misappropriate or infringe any copyright, trademark or other intellectual property right of any other person or entity. You will take, at Sponsor’s expense, any further action, including without limitation execution of affidavits and other documents, reasonably requested by Sponsor to effect, perfect or confirm the license granted to Sponsor to your application as set forth herein. In exchange for the license to your application, if published, used and/or posted on Sponsor’s site, said site will include your first name and last initial in conjunction with such publication, posting or use. Applications become the sole property of the Sponsor and none will be returned or acknowledged except as provided herein.
GENERAL TERMS:
Applicants agree to be bound by these Rules. Applicants, by participating in this Program, hereby waive and release, and agree to hold harmless the Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a grant in the Program, or their participation in the Program, or their participation in any Program or grant related activity. Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible applications or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Program. Sponsor and its agents are not responsible for any injury or damage to applicants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Program. Sponsor reserves the right to cancel or suspend advertising the Program on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the Program. Sponsor reserves the right to disqualify any applicant found to be disrupting the operation of the Program or its web site. No transfer or assignment of applications is permitted.
